Terms of Service.

Each hosting plan includes a set number of editing hours per month. Editing time beyond the hours included in your plan is billed at $125/hour, in 15-minute increments. Overage is invoiced at the end of the billing period in which the work was performed.

Moving your site to another platform or account carries a one-time $125 fee. The transfer is completed within two business days after that payment is received.

You confirm that all information, text, images, and other materials you provide to DMS Studios to build your site, app, or print materials are owned by you or licensed for your use. DMS Studios assumes no responsibility or liability for the ownership of any content submitted to our team.

Plans renew automatically for the billing period you select and can be cancelled anytime from your account portal. Fees already paid are non-refundable. Cancellation takes effect at the end of the current billing period; your site and services remain active until then.

Each plan defines the work included (pages, edit hours, and turnaround expectations). Requests outside that scope — new pages, redesigns, custom features, or rush turnarounds — are quoted separately as a new project before work begins.

Turnaround estimates begin once we receive all required content and assets from you. Delays in supplying content, feedback, or approvals extend delivery timelines accordingly. For print orders, production begins only after you approve the final proof — approved proofs are final and not eligible for reprint due to content errors.

We make commercially reasonable efforts to keep hosted sites available and perform scheduled maintenance during low-traffic windows. We do not guarantee uninterrupted service and are not liable for outages caused by third-party providers, force majeure events, or circumstances beyond our reasonable control.

Failed or past-due payments may result in suspension of services until the balance is settled. Accounts past due by more than 30 days may be terminated, and site files may be removed after notice.

You may not use our services to host or distribute illegal content, malware, spam, or material that infringes the rights of others. We may suspend or terminate services that violate this policy.

Upon full payment, you own the final deliverables created for you. DMS Studios retains ownership of pre-existing tools, frameworks, templates, and processes used to produce the work, and may showcase completed work in our portfolio unless you request otherwise in writing.

To the maximum extent permitted by law, DMS Studios' total liability for any claim arising from our services is limited to the amount you paid us in the three months preceding the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

Either party may terminate services with written notice. Upon termination, we will provide a reasonable export of your site content (subject to the transfer terms above where applicable). Fees already paid remain non-refundable.

These terms are governed by the laws of the State of New York. Any dispute will first be addressed through good-faith negotiation; if unresolved, disputes will be handled in the state or federal courts located in New York.
